ON MEXICO ISSUE

  • At least 670 workers at the Velardeña mine, owned by the company Peñoles, located in the municipality of Cuencamé, Durango, closed the facilities of the mining complex to demand payment of profits, this after last April the company reported that there will be no profits because the mine It was declared zero last year. Workers accused the local leaders of the “Frente” Mining Union and the national Carlos Pavón Campos of being at the service of Peñoles, since, they say, this is the third time that the company represented by Alejandro Baillères does not make the corresponding payment of the profits. The claim of the 670 workers of the Velardeña mine is added to the demands of the United States government to Industrias Peñoles to review the working conditions in one of its mines. This request responds to a request from the National Union of Mining, Metallurgical, Steel and Steel Workers. Similar ones from the Mexican Republic, headed by  senator Napoleón Gómez Urrutia of the Morena political party, who points out the alleged denial of the rights of free association and collective bargaining in one of the group’s mines. The Velardeña mine began operations in May 2013 and is currently the most important Zinc mine of Industrias Peñoles and the second largest nationally, which places Durango as one of the three main zinc-producing states in Mexico.
  • Mining companies lose up to 15% of their profits due to the “Mexican superpeso”. The results of Grupo México, Torex Gold and Cuzcatlán were weak due to the appreciation of the Mexican currency. As the Mexican peso gains ground against the dollar, mining companies such as Grupo México, Torex Gold or Cuzcatlán face a complex environment because mineral export contracts are handled in US currency, which caused profit margins to be impacted by up to a 15 percent.

Overall recoveries will need further testing to establish a better estimate for overall recoveries of gold and silver, but KCA is very optimistic about the process”. Additionally, Grupo Minero WIYA is modifying the SDA Plant in Nayarit in order to produce a single bulk concentrate production, and has commenced shipping mineralized material from their mine to the SDA Plant. Approximately 550 tonnes of mineralized rock has been received at the SDA Plant in preparation for the restart of the mill, once 1500 tonnes has been delivered. At El Oro Gold hard rock project, Xali Gold is in discussions with a local mining group to extract and process mineralized backfill from the historic San Rafael mine in Mexico State. The agreement would involve sharing profits from recovering gold and silver materials, while also providing underground access for drilling to explore new mineralized zones. Drilling from underground is more cost-effective than drilling from the surface due to the presence of up to 300m of volcanic rocks above the gold and silver veins. The historic mine has a significant production history of 5 million ounces of gold equivalent (4M Oz Au and 44M Oz Ag), indicating the potential for further mineralization at depth.

Mexico’s Best Drilling Intercepts, Second Week of April 2024

Three companies released drilling results during the week coming from projects in Mexico: Pan American Silver on La Colorada Skarn in Zacatecas, Prime Mining on Los Reyes in Sinaloa and Goldgroup Mining on Cerro Prieto in Sonora.

Pan American Silver’s impressive grade*meter numbers on silver, lead and zinc come from the ongoing infill and geotechnical drill program at La Colorada Skarn project, adjacent to its La Colorada property, where they are mining an intermediate sulfidation vein system. Prime Mining’s results are from Expansion drilling on the Tahonitas area at Los Reyes, where the company believes the early-stage intersections demonstrate the Tahonitas structure continues to be mineralized for 350 m along strike and may support pit expansion to the southeast near surface, as well as an increased potential for high-grade plunging shoots that might provide “high-margin underground feed”.

The newcomer on this weekly review is Goldgroup Mining, with results from 2023 drilling at its Cerro Prieto mine in Sonora. Cerro Prieto is within 10 K from Agnico Eagle’s Santa Gertrudis project and even closer from Sonoro’s Cerro Caliche project. Cerro Caliche is a low sulfidation system hosted in Tertiary volcanic rocks and Triassic-Jurassic sedimentary rocks intruded by an Eocene granodiorite stock, whereas mineralization at Santa Gertrudis includes disseminated gold in sedimentary rocks that has been described as Carlin-Style and/or low sulfidation epithermal, and clear low sulfidation quartz stockworks and veins. At Cerro Prieto, mineralization developed in a shear zone up to 65 m in width. Unfortunately the description of the local stratigraphy for Cerro Prieto on their last technical report (2023) comes at odds with the published government maps and include some bizarre descriptions for at least one of the units. Mineralization is interpreted by Goldgroup to have come in two stages, an early mesothermal one that would attest for the Pb, Zn and Mo grades and a later low sulfidation epithermal that would introduce the higher gold values and the silver. The old Cerro Prieto mine was one of the type localities for wulfenite (PbMoO4).

ON MEXICO ISSUE

  • Fortuna Silver Mines Inc., reported an illegal blockade at its San Jose mine in Oaxaca due to a group of workers did not agree with the estimated amount the Company is to distribute among the workforce as part of the worker´s profit sharing entitlement. Profit sharing is a transparent calculation and is payable in accordance with Mexican legislation.  As a consequence, operations at the mine have been temporarily halted.
  • At least 40 companies from Canada and the United States that operate in Mexico expressed their intention to protect themselves after the approval of the reforms to the Mining Law by the government because they consider that they are violating their rights and that they are being changing the rules of the game. The law firm Von Wobeser y Sierra, anticipated that they will also consider the international arbitration considered as a mechanism to resolve disputes within the framework of the Free Trade Agreement between Mexico, the United States and Canada (T-MEC) and the Trans-Pacific Economic Cooperation Agreement (TPP). The elimination of the concepts of Free Land and First Applicant are the elements that most concern companies because with them the government could “legalize” the non-granting of concessions to private parties, by giving the exploration monopoly to the Mexican Geological Service (SGM). ), warned the Mining Chamber of Mexico (Camimex). Until now, the Canadian mining company Silver Bull Resources presented in March to the International Center for Settlement of Investment Disputes (ICSID) its intention to claim economic damages for at least USD $178M for the blockade of its Sierra Mojada Project since September 2019. The American Vulcan Materials presented to ICSID a claim for an estimated damage of at least USD 1.9 B against Mexico for the closure and occupation of the Sac-Tun mine (formerly Calica) and the Punta Venado pier in Playa del Carmen. A resolution on this issue is pending since May 2022.
  • Chesapeake Gold Corporation has initiated legal proceedings against the Dirección General de Minas of Mexico (DGM) with the Federal Court of Administrative Justice in the state of Durango, Mexico in response to the DGM’s cancellation of the San Vicente 3 mineral concession, on the basis that the Company did not provide adequate evidence to support the Company’s performance of the exploration work required to maintain the concession. The Company’s legal position, approved by external Mexican legal counsel, is that the work required to maintain the concession was conducted on the property and appropriate evidence was submitted to the DGM to substantiate the work. The San Vicente 3 mineral concession is one of 12 mineral concessions comprising the Metates property, representing 700 hectares of the 4,260 hectares in the Metates project, and encompasses a portion of the Metates mineral resource. The Company intends to vigorously defend its position with respect to the San Vicente 3 mineral concession.
  • Radius Gold Inc., filed a legal demand with a Federal Mexican Court to obtain title to the Amelia 4 mining concession at its Amalia project in Chihuahua. “Radius and project JV partner Pan American Silver Corp. have completed all the requirements, fee payments and surveys for the Amalia 4 application.  The mining authority of Chihuahua has processed and approved the submission without fault and passed the license to the Mexico Mining Directorate proposing title issuance.  The regulated time for the mining authority to comment and request revision has passed and granting of title is a legal requirement under the mining law.  Radius has filed a legal demand to enforce the granting of title.  Radius legal counsel believes the Company has clear legal right to the application and title.  Legal counsel has been successful in obtaining granted concessions in similar situations recently”.
  • The Senate of Mexico approved the mining reform that reduces and facilitates the cancellation of concessions. The legal changes were approved despite Canada’s claim and in an express session in which twenty laws and reforms were endorsed in just five hours.  The senators approved modifications to the Mining, National Water, General Ecological Balance and Environmental Protection laws, and the General for the Prevention and Integral Management of Waste. The reform will allow the government to only grant mining concessions through a public tender and with prior consultation with indigenous peoples, in addition to facilitating the revocation of the license for environmental damage. The reform could generate tensions with the partners of the T-MEC, in particular with Canada, which has already complained in recent days. The Canadian Minister of International Trade, Mary Ng, revealed last Wednesday that she spoke with the Secretary of the Economy of Mexico, Raquel Buenrostro, to express the “concern” of the Canadian government with the then proposed reform of the country’s mining sector, in the that Canadian companies constitute the largest foreign investor.

ON SOCIAL RESPONSIBILITY

  • Almaden Minerals Ltd., completed a social impact assessment  (SIA) relating to its Ixtaca project in Puebla, and underlying mineral claim area, and the completion of a human rights impact assessment (HRIA) that examines the potential impacts that could be caused if the Ixtaca project is developed in a manner consistent with the Ixtaca Feasibility Study. “The SIA concluded that there were no elements identified that would justify the cancellation of the concessions so long as the necessary social management measures were in place to avoid, mitigate or compensate for the potential negative impacts and amplify the positive ones. The HRIA represents a much more significant and holistic study than the SIA, as it aims to predict, identify, characterize, and assess the potential positive and negative impacts that the Ixtaca project could have during its lifespan on the human rights of both indigenous and non-indigenous communities located within its areas of influence and on other identified project stakeholders. In the event potential impacts are identified, the HRIA proposes strategies to amplify the positive and mitigate or compensate for the negative”.

ON MEXICO ISSUE

  • Altos Hornos de Mexico S.A.B. de C.V. (AHMSA), assured that the power outage at its plants is an act of bad faith derived from charging millions of dollars to Federal Electricity Commission (CFE) for illegal cancellation of coal supply. AHMSA is owned by Mexican businessman Alonso Ancira, who assured that CFE’s actions are unjustifiable because they represented the loss of 4,000 direct jobs and more than 8,000 indirect ones, in addition to having generated disorder in the general coal industry. “These aggressive actions began after the Judiciary accepted a claim for damages for USD $700M for the unilateral and illegal cancellation of the supply of coal for the two generating plants located in Nava, Coahuila,” accused the company. “AHMSA stated that the actions taken by the management of the CFE show that it does not care about harming Coahuila and the people of Coahuila, since our plants located in that entity represent a direct source of livelihood for 17,000 Coahuila families.
  • Karen Flores, General Director of the Mining Chamber of Mexico (CAMIMEX), declared that the Federal Government stops additionally collecting up to MXP $25 B after the suspension of mining concessions and the paralysis of new permits. She explained that the policy of President Andres Manuel Lopez Obrador has halted more than 800 mining projects that only await federal authorization to start operations. “If the projects that are stopped were to start up, we would be talking about MXP $20 to 25 B per year to the federal treasury,” she said. She maintained that only in terms of taxes, the industry entered the public coffers in 2021 more than MXP $60 B and in seven years, MXP $240 B, an amount that could be higher if there were no obstacles in the current legislation.
  • The Secretariat of Economy identified 159 mining companies with foreign capital operating in 26 states of Mexico (mostly juniors and exploration) in 2021. These companies operate 1,209 projects, of which 822 were halted and nine operations reported closing at the end of last year. The mining GDP in Mexico was MXP $865.2 B in 2021, a growth of 1.6% year-on-year, in real terms (based on GDP calculated in constant MXP $ with purchasing power as of December 31, 2013). For their part, mining-metallurgical exports amounted to USD $23,579M in 2021, a figure that meant an increase of 28.1% compared to the previous year. The significant increase in exports allowed that, despite the increase that was also reported in imports, an increase in the positive balance of the mining-metallurgical trade balance of 29.6% was registered and reached a value of USD $11,904M. The positive results in foreign trade in minerals consolidated the mining-metallurgical industry as the fifth source of foreign exchange, surpassing tourism and the agricultural sector, and only behind the automotive industry, the electrical and electronic equipment and machinery industry, remittances and oil exports. The mining sector presented an increase in the contribution to the National GDP, going from 2.3% in 2020 to 2.5% in 2021, and in the Industrial GDP the record went from 8.3% to 8.6% in the study period, according to data from the Mining Chamber of Mexico. Gold remained the main product of the national mining-metallurgical industry in 2021, with a share of 28.4% in the total value of production, followed by copper with 27.7% and silver with 20.4%.
  • According to the Mexican Mining Chamber (CAMIMEX), Newmont, Industrias Peñoles and Fresnillo operated the main zinc mines in Mexico in 2021. Peñasquito, owned by Newmont and located in the state of Zacatecas, leads the ranking, with 245.84K tonnes Zn, then follow two mines of Industrias Peñoles: Velardeña, Durango with 909.68K tonnes Zn, and Tizapa State of Mexico with 40.13K tonnes Zn. The table below shows the Zn production by mine for the year 2021:

The Buenavista Zinc project, in Sonora, is located within the Buenavista facilities and includes the development of a new concentrator to produce approximately 100K tonnes Zn and 20K tonnes Cu per year.

While the project has all the necessary permits, the project budget is USD $413M and is expected to start operations in 2023. As of December 31, 2021, Grupo México had invested USD $217M in this project. When completed, Grupo México anticipates that this new facility will double the company’s zinc production capacity and provide 490 direct and 1,470 indirect jobs. Other notable companies are: Gatos Silver, Minera Frisco and Gold Resource.

  • Maria Luisa Albores, the Secretary of the Environment and Natural Resources (SEMARNAT) informed deputies, in a very unfortunate statement, that the federal government will not grant more authorizations for open-pit mining due to the negative impacts on the environment and human health. When appearing before the joint commissions for the Environment and Natural Resources, and Climate Change and Sustainability of the Chamber of Deputies, the federal official also announced that mining concessions were detected in 68 Protected Natural Areas, “which contravenes the conservation and protection of the territory and its natural resources”. Opposition legislators such as the PAN members questioned the programs of this administration such as “Sembrando Vida”, pointing out that they do not have operating rules that allow their transparency and the energy transition has been aborted, in addition, environmental deforestation is not punished.
  • Grupo Mexico maintained its position as the largest copper producer in Mexico, adding a total of 559.83K tonnes Cu in 2021. The company maintains copper production operations in Sonora, Chihuahua, San Luis Potosí and Zacatecas. With this, the company registered a coverage of 76.3% of the national copper production in 2021. The table below shows the Cu production by mine during 2021:
